These Terms of Service (“Terms”) govern your access to and use of FlyViewPro’s website and desktop application. By accessing or using FlyViewPro, you agree to these Terms.

If you do not agree to these Terms, do not use FlyViewPro.

Data Collection and Diagnostic Consent
By installing or using the Software, you acknowledge and agree that FlyViewPro may collect and process certain technical and diagnostic information, including crash reports and error logs, as described in our Privacy Policy. This information is used solely to operate, maintain, and improve the reliability and performance of the Software.

1. About FlyViewPro

FlyViewPro is a specialized video debriefing and analysis tool designed for skydiving and wind-tunnel activities. It enables users to review, synchronize, and analyze video footage related to their jumps or training sessions.

FlyViewPro is not a general-purpose video editing tool and does not provide professional, instructional, or coaching guarantees.

2. Eligibility

You must be at least 16 years old to use FlyViewPro.
If you are under 18, you confirm that you have permission from a parent or legal guardian to use the service.

3. Accounts and access

To use certain features, you may be required to create an account.

You are responsible for:

Maintaining the confidentiality of your account credentials
All activity that occurs under your account

You may not share your account with others or allow others to access FlyViewPro using your account.

4. License and permitted use

4.1 License grant

Subject to these Terms, FlyViewPro grants you a personal, non-exclusive, non-transferable license to use the software.

4.2 Per-user license

Licenses are issued per individual user
Each user may activate the software on up to two personal devices
Devices must be under your control and primarily used by you

4.3 Coaching use

You may use FlyViewPro to review footage together with students or peers, including in a coaching context, provided that you are the account holder and the software is not shared with other users.

4.4 Prohibited use

You may not:

Share your account or license with other individuals
Use a single account on a shared or public computer (e.g. tunnel, dropzone, or facility computers) for multiple users
Circumvent device or license limitations
Use FlyViewPro in a manner that enables multiple unrelated users to access the software under one account

Commercial or facility-wide use requires separate authorization from FlyViewPro.

5. User content

5.1 Ownership

You retain full ownership of all video and other content you use with FlyViewPro.

FlyViewPro does not claim ownership of your content.

5.2 Responsibility

You are solely responsible for:

The content you process or upload
Ensuring you have the rights and permissions to use such content
Compliance with applicable laws and regulations

FlyViewPro does not review, monitor, or moderate content by default.

6. Local processing and uploads

Video files are processed locally on your device by default
FlyViewPro does not upload video content automatically
Any upload of content requires explicit user action and will clearly indicate what data is being uploaded and for what purpose
Use of the Software may involve automated collection of crash and diagnostic data (e.g., via third-party services such as Sentry) in order to improve software reliability.

7. Payments, pricing, and refunds

Paid features require payment through Stripe
Prices and available plans may change at any time
Payments are non-refundable, except where required by applicable consumer law

Nothing in these Terms affects your statutory consumer rights.

8. Acceptable use

You agree not to:

Use FlyViewPro for unlawful purposes
Interfere with or disrupt the software or its systems
Attempt to reverse engineer, modify, or bypass technical protections

FlyViewPro is a content-agnostic tool and does not assess the legality of activities depicted in user content. Responsibility for lawful use remains with the user.

9. Intellectual property

FlyViewPro, including its software, design, branding, and documentation, is protected by intellectual property laws. You may not copy, distribute, or create derivative works of FlyViewPro except as expressly permitted by these Terms.

10. Availability and changes

FlyViewPro may be updated, modified, or discontinued at any time.

We do not guarantee:

Continuous availability
That the software will be error-free
That specific features will remain available

11. Disclaimers

FlyViewPro is provided “as is” and “as available”.

To the maximum extent permitted by law, FlyViewPro disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

FlyViewPro does not guarantee:

Performance outcomes
Training results
Accuracy of analysis
Compatibility with all hardware or systems

12. Limitation of liability

To the maximum extent permitted by law, FlyViewPro shall not be liable for:

Loss of data
Hardware or software damage
Lost profits or business opportunities
Decisions made based on the use of the software

FlyViewPro’s total liability shall not exceed the amount paid by you for the software in the twelve months preceding the claim.

13. Termination

We may suspend or terminate your access to FlyViewPro if you violate these Terms.

Upon termination:

Your license will be revoked
You must stop using the software

14. Governing law

These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles.

15. Changes to these Terms

We may update these Terms from time to time. Updated versions will be published with a revised “Last updated” date. Continued use of FlyViewPro after changes take effect constitutes acceptance of the updated Terms.
